Arvin Personal Injury Attorney

Kern County

Bear Mountain Boulevard, the stretch of State Route 223 that runs through Arvin, is the only street in town with traffic signals, and it recorded 143 collisions from 2015 to 2019, more than any other road in the city’s safety plan (Arvin LRSP). East of Derby Street the posted speed rises from 30 to 55 mph, and from Derby to Malovich Road the south side has no sidewalk. This page follows one hypothetical injury on that stretch from the moment of impact to the end of the case, so that anyone looking for an Arvin personal injury attorney can see which local offices, records and deadlines shape a claim here.

Arvin in figures

  • Kern COG’s 2022 study counted 620 collisions on Arvin streets over five years; roughly 1 in 50 killed or badly hurt someone (LRSP)
  • Turning mistakes (28.4%), failing to yield (16.8%) and speed (14.4%) together explained about 60% of the 620
  • Pedestrian errors showed up in only about 2% of crashes yet in 21.4% of the deadly or disabling ones
  • Of every kind of Arvin collision, those involving someone on foot carried the worst odds, 14.3% ending in death or severe injury

Those figures, and the city’s 19,820 residents (Census 2025 estimate), are why the example below involves a woman walking home from the fields.

A hypothetical claim, from the shoulder to the first offer

Hypothetical example. Rosa, the pickup and the van are made up for illustration, as is every step that follows; real Arvin claims vary and outcomes cannot be predicted.

Dusk, east of Derby Street

Rosa finishes a shift in the fields and walks home along the south shoulder of Bear Mountain Boulevard, where the plan confirms there is no sidewalk. A pickup accelerating into the 55 mph zone drifts right and clips her. The driver pulls over, and a passing farm-labor van calls 911.

Arvin Police at the scene

An Arvin Police Department officer arrives, since this part of SR-223 lies within the city. Before the officer leaves, Rosa’s son collects three things:

  1. The Arvin Police report number
  2. The farm-labor van driver’s cell number, since he saw the pickup drift
  3. Photos of the shoulder, the edge line and the spot where the sidewalk ends

Whether the officer measured her position from the white edge line, and photographed the missing sidewalk, will matter more than anything else in that report.

Fifteen miles to Kern Medical

The ambulance drives roughly 15 miles northwest to Kern Medical, the one adult Level II trauma center that the state’s list shows for Kern County (EMSA). Doctors set a fractured tibia and monitor a concussion. Months of physical therapy follow, and the harvest-season paychecks Rosa misses become part of her lost-wage claim.

The adjuster’s phone call

Four days later an adjuster for the pickup’s insurer phones Rosa’s kitchen and asks to record her account in English. Arvin’s plan suggests why: pedestrian violations figure in a fifth of the city’s serious crashes, so the carrier will try to put Rosa in the lane rather than on the dirt beside it.

Tip: No one hurt on an Arvin road is required to give the pickup driver’s carrier a recorded interview, in English or Spanish. Send that call to your attorney. Tell your own insurer about the crash, though, because medical-payments or uninsured motorist benefits on your own policy may apply.

Where else Arvin residents get hurt

Location2015–2019 findings
Meyer St, incl. at Sycamore Rd and Franklin St59 collisions; 27% broadsides, 25% rear-ends; 19% at Sycamore
Comanche Dr49 collisions, 40.8% rear-ends; 45 mph with missing sidewalk stretches
Bear Mountain Blvd at Comanche Dr31 collisions, 38.7% rear-ends; new crosswalks and signal backplates recommended
Derby St26 collisions; right-of-way and speed 19.2% each
Bear Mountain Blvd at Hill St20 collisions; improper turning 35%, signal and sign violations 20%
Bear Mountain Blvd at Derby StMost broadsides and sideswipes on the corridor

Deadlines, court and the end of the case

The second half of Rosa’s case turns on two clocks and one courthouse.

The driver claim and the road claim

ClaimAgainstDeadline
Negligent drivingThe pickup driver and insurerGenerally 2 years to sue (CCP §335.1)
Missing sidewalk or abrupt 55 mph zoneWhichever public body owns that piece of Bear Mountain BoulevardWritten claim generally within 6 months (Government Code §911.2)

The second claim exists only if the road helped cause the injury, for example if the missing south-side sidewalk or the abrupt jump from 30 to 55 mph pushed Rosa and the pickup into the same strip of pavement. A documented gap in the city’s own plan is a starting point for that argument, not proof of it, and the half-year deadline arrives long before most Arvin cases settle.

When the carrier blames Rosa

Suppose a jury decides Rosa should have walked farther from the edge line and assigns her a quarter of the blame. Under California’s pure comparative fault rule, her verdict shrinks by that 25% and the pickup’s insurer owes the rest (CACI 405).

Lamont or Bakersfield

Lamont, at 12022 Main Street, is the court’s closest branch to Arvin. With a broken tibia, months of therapy and a lost harvest season, Rosa’s damages plainly exceed $35,000, so her complaint goes to the Metropolitan Justice Building at 1215 Truxtun Avenue in Bakersfield, which the court’s civil page names for claims above that amount (Kern Superior Court).

How it ends

Rosa’s claim could settle after her treatment ends, go to mediation, or be tried before a Bakersfield jury. Which of those happens depends on the evidence from Bear Mountain Boulevard, the insurance on the pickup and the course of her recovery, and no attorney can promise a figure.

Alcohol and motorcycle rankings for 2023

On the state’s 2023 tables, Arvin sits mid-pack overall, 30th of 103 cities its size, with 53 people hurt or killed. Two rows are far worse (OTS 2023). Crashes caused by had-been-drinking drivers between 21 and 34 injured or killed 11 people, second only to one other city in the group. Five motorcycle riders were killed or injured, placing Arvin fifth. Across all alcohol-related crashes, the 13 victims put Arvin 19th.

The arrest column for Arvin reads zero, which earns a rank of 2nd, because that column counts upward from the city with the fewest arrests. OTS cautions that not every police agency sends its arrest counts in, and Arvin’s zero may be one of those reporting holes rather than a sign that no impaired drivers use Bear Mountain Boulevard.

Sidewalks, alcohol and the Lamont branch

There’s no sidewalk on my side of Bear Mountain Boulevard. Can the insurer blame me for walking on the shoulder?

It can try. The plan itself records that the south side has no sidewalk from Derby to Malovich, which answers the claim that you should have used one. Any argument about your position or clothing at dusk only reduces a recovery; it does not erase it.

The pickup driver had been drinking. What difference does that make?

Impairment usually decides liability and can justify asking for punitive damages from the driver personally. His insurance limits stay the same, though, which is why we check your own underinsured motorist coverage early.

The courthouse in Lamont is close. Why would my case go to Bakersfield?

Lamont is on the court’s list of civil locations, but an Arvin injury claim worth more than $35,000 goes to the Metropolitan Justice Building downtown.

I speak Spanish at home. Will that be a problem?

No. Spanish is the home language for roughly 83% of Arvin (Wikipedia); our site at calljacob.com/es explains the process in Spanish.

Representing farmworker families in Arvin

We represent Arvin farmworkers, students, parents and commuters hurt on Bear Mountain Boulevard, Comanche Drive, Meyer Street and Weedpatch Highway. When we take an Arvin case, we pull the Arvin Police report, place the crash on the city’s ranked-location map, and decide within weeks whether the missing sidewalk or the 55 mph transition on SR-223 justifies a government claim.

Pedestrian crashes carry the most serious outcomes in Arvin’s data and vehicle collisions make up most of the 620, so pedestrian accident and auto claims come first in how we handle cases for people hurt here. The Law Offices of Jacob Emrani also handles motorcycle crashes, collisions with farm and oil-field trucks, bicycle injuries, injuries to Arvin Transit passengers and wrongful death claims.

A representative can sit down with your family at home in Arvin or at your bedside in Bakersfield, and that first meeting costs nothing. Our fee is contingent on the outcome: it comes out of a settlement or verdict, and if there is none, an Arvin family owes us no fee. Reach the firm at (888) 952-2952, or lay out the Bear Mountain Boulevard details in writing through our case evaluator.

Rosa’s case is fiction; Arvin’s crash figures and California’s filing rules are real but summarized for general information, not legal advice.
