Arcadia Personal Injury Attorney

Los Angeles County

Only 15 of the 103 California cities in Arcadia’s population group had more traffic victims than Arcadia’s 311 in 2023, a striking total for a place of about 54,000 residents (OTS; Census). Within that figure, the group that fares worst against peer cities is children under 15 riding bicycles. Parents who sit down with an Arcadia personal injury attorney after a child is hurt usually want to know one thing first: what happens next, and in what order. This page answers that by following a single hypothetical claim through the offices, hospitals and rules that apply here.

At a glance — Arcadia

  • Six riders younger than 15 were struck in 2023; just eight peer cities had a worse record (9th of 103)
  • Riders outnumbered walkers among the injured, 21 to 15
  • Santa Anita Park, The Shops at Santa Anita and the Arboretum cluster at Huntington Drive and Baldwin Avenue
  • For trauma care, ambulances head west to Pasadena’s Huntington Memorial, a Level II center

Following one claim from start to finish

Ava, the child in this example, is invented. The streets, agencies and laws around her are real, and the order of events is close to what an Arcadia family can expect.

A turn out of the mall driveway

Hypothetical example: On a Saturday afternoon, twelve-year-old Ava is pedaling home along Baldwin Avenue. A driver pulling out of The Shops at Santa Anita swings right without checking for a bicycle, and Ava goes over the handlebars. Her wrist is broken. A shopper dials 911.

Baldwin Avenue is a believable place for this to happen. South of Huntington Drive it is the spine of a commercial district, and the Arboretum’s entrance sits across the intersection from the racetrack and the mall (Wikipedia). Drivers heading for any of those three destinations are watching for a parking space, a gap in traffic or a gate, and a 12-year-old on a bike is small in that field of view. Arcadia has its own police department, and its officers take the report on Baldwin. Ava’s father writes down the officer’s name and badge number, the report number, and the shopper’s phone number before the ambulance leaves.

The night at USC Arcadia Hospital

Paramedics take Ava to USC Arcadia Hospital, a 460-bed acute-care hospital that opened on its 22-acre site in 1957 (Wikipedia). A child with a head injury or internal bleeding could instead be routed to Huntington Memorial in Pasadena, the nearest designated trauma center, at Level II (EMSA). A broken wrist in a 12-year-old is often followed for months, because the bones are still growing. The orthopedic visits, the second set of X-rays and any physical therapy all belong in Ava’s claim, so her parents keep each discharge sheet and appointment card in one folder from the first night.

Gathering the Baldwin Avenue evidence

Ava’s family calls us on Monday. That week, our office works through this list:

  • A copy of the Baldwin Avenue report and its scene photos
  • Parking-lot video from the mall, the racetrack and the Arboretum facing Baldwin
  • The bent bicycle and cracked helmet, stored untouched
  • A written statement from the shopper who called 911
  • The driver’s insurer and policy number

A property that size records a great deal, but its footage is not kept indefinitely, which is why the letters asking each owner to hold it go out in the first days.

The driver’s insurer and the family’s policy

The driver’s liability carrier owes for Ava’s injuries if its driver was negligent. Ava’s parents check their own auto policy too, because medical payments coverage would pay some early bills no matter who caused the crash. When the driver’s adjuster telephones on Wednesday and asks Ava’s mother for a recorded statement about the afternoon, she gives the adjuster our number instead.

Tip: Keep pictures of the cast, the bike and Baldwin Avenue off Instagram and Facebook until the claim is resolved. An insurance adjuster reading a parent’s post will look for anything that seems to minimize the injury.

If a public agency had a role

Change one fact and the timeline changes. Picture the same afternoon, but the vehicle that struck Ava belongs to the city’s public works yard, a school district or Metro, whose A Line trains cross streets at grade near Arcadia Station. The family’s claim then runs against a public entity, which must generally receive a written government claim within six months (Gov. Code §911.2). A missing crosswalk or a dark signal on a city street raises the same deadline.

Being a minor does not stop that clock. Ava’s own right to sue the mall driver is generally preserved until she turns 18 (CCP §352). Her parents, though, paid the USC Arcadia bills themselves, and that parental claim generally runs on the adult two-year statute of limitations (CCP §335.1).

Watch out: Families who wait on the strength of the child’s longer deadline can lose the parents’ part of the case.

Court approval of a child’s settlement

Ava’s claim is valued once her doctors can describe where her wrist will end up. Because she is a minor, any settlement goes to a judge for approval, a protection that keeps the money for her benefit until she is an adult (Prob. Code §3500).

Suppose the insurer argues that Ava was riding on the wrong side of Baldwin. Under comparative fault, even if jurors believed that, they would assign Ava a percentage and lower her compensation by that amount; the claim itself survives (CACI 405).

Without a fair offer, the next step is a complaint in Los Angeles Superior Court. Since 2024 the court has spread new personal injury filings among its judicial districts according to where each incident happened, so the address on Baldwin Avenue, run through the court’s locator, tells a Los Angeles County personal injury attorney which district hears Ava’s case (LASC).

What parents in Arcadia want to know

Why is the total so high for a city of 54,000?

The comparison is with cities of similar population, and few of them host a major racetrack, a regional mall and a botanic garden at a single intersection. Visitors driving in on Huntington, Foothill and Colorado help explain a total that a purely residential city of the same size would be unlikely to reach.

My son was hit near the Arboretum entrance. Whose insurance pays for his follow-up care?

Start with the negligent driver’s coverage. When a serious injury exhausts it, the underinsured motorist coverage on your own policy generally extends to children living in your home.

Do Arcadia police handle the Foothill Freeway?

No. Those reports belong to the CHP.

My grandmother was crossing Huntington Drive outside the crosswalk. Does she still have a claim?

She can, and an Arcadia pedestrian accident lawyer would start with exactly where she was crossing. Arcadia was 19th of 103 for pedestrians 65 and older injured in 2023, and a senior who bears some blame still recovers the driver’s share of the harm.

What if a Metro train struck someone near Arcadia Station?

A Line trains cross streets at grade near Arcadia Station, which opened in 2016. Because the train belongs to a public agency, the family has six months to present a written claim to Metro, long before the two-year limit that applies to a private driver.

Wrecks on the Foothill Freeway sit outside this table because the Highway Patrol, not Arcadia police, reports them (OTS). The racetrack dates to 1934, the Arboretum covers 111 acres, and historic Route 66 survives as Colorado Boulevard; all three draw drivers from well outside the city.

Our Arcadia practice

We represent Arcadia children and their parents, older residents and visitors to Santa Anita Park, the mall and the Arboretum who are hurt on Baldwin Avenue, Huntington Drive, Foothill Boulevard and Colorado Boulevard. For each Arcadia client, our first requests go to the city police department for its report and to USC Arcadia Hospital or Huntington Memorial for the chart, and our next go to the large properties whose cameras covered the scene.

Because the local data point to young riders, bicycle accidents come first on the list of cases we take. Drivers who need an Arcadia car accident attorney come to us as well, and we also handle auto accident claims for passengers, pedestrian accidents involving seniors, motorcycle crashes, A Line train and bus collisions, falls at shopping and event venues, dog bites, and wrongful death cases.

For a free consultation, an Arcadia bicycle accident lawyer from our office will sit down with you at home, at USC Arcadia Hospital or at Huntington Memorial. If we take the case, our fee is a percentage of what is recovered, so a family that recovers nothing pays us nothing. Parents can begin by phoning (888) 952-2952. Anyone looking for an injury lawyer near Santa Anita can also describe the crash in writing through the online intake form, and Spanish-speaking families can read about us at calljacob.com/es.

A hypothetical family, real Arcadia institutions and general California rules: none of it is legal advice for your own case.
