Aliso Viejo Personal Injury Attorney
Orange County
Aliso Viejo has some of the safest streets of any California city its size, with one exception parents should know about. In 2023, seven bicyclists younger than 15 were hurt on its roads, the 4th-highest count among 103 comparable cities, and they made up half of all cyclists injured in the city that year (OTS).
The city was planned from 1982 for about 50,000 residents and 20,000 homes, and its traffic moves along a handful of arterials that feed the San Joaquin Hills Toll Road (Wikipedia). Because so much of daily driving runs through so few roads, this guide is organized by corridor. For each one it describes what happens there, which agency investigates and what evidence a claim would draw on, so that anyone weighing a call to an Aliso Viejo personal injury attorney knows what matters on that particular stretch.

Driving the San Joaquin Hills Toll Road
State Route 73, the San Joaquin Hills Toll Road, opened in November 1996 and has used all-electronic tolling since 2014. It has four Aliso Viejo interchanges (Wikipedia):
| Interchange | Toll |
|---|---|
| Moulton Parkway | Free |
| La Paz Road | $2.81 |
| Aliso Creek Road | $3.50 |
| Pacific Park Drive/Glenwood Drive | Free |
Crashes on the toll road are investigated by the CHP Capistrano Area, on Camino Capistrano in San Juan Capistrano, which patrols SR-73 along with I-5, SR-74, SR-133, SR-241 and Pacific Coast Highway (CHP), so a crash on the toll road produces a CHP report even though Orange County Sheriff’s deputies police every other street in Aliso Viejo.
Because every trip on the 73 is recorded electronically, your own FasTrak or toll account statement can help confirm when and where you entered the road, which is useful if the other driver disputes the timeline.
Tip: If you were driving the 73 without FasTrak when you were hurt, the toll still has to be paid within five days to avoid a penalty (Wikipedia). It is an easy thing for a family to miss while someone is in the hospital.
A safe ranking with one exception
| 2023 measure | Count | Rank of 103 |
|---|---|---|
| Cyclists under 15 | 7 | 4 |
| Pedestrians under 15 | 3 | 20 |
| All cyclists | 14 | 36 |
| Speed-related crashes | 19 | 65 |
| Alcohol-involved victims | 11 | 75 |
| All victims | 105 | 83 |
| All pedestrians | 6 | 85 |
| Nighttime crashes | 8 | 89 |
| Hit-and-run crashes | 4 | 91 |
On the state’s composite measure Aliso Viejo placed 92nd of 103, among the lowest-risk cities in its group, where 1 is the worst (OTS). The child figures run the other way. Half of the city’s six pedestrian victims were also under 15, and none of these counts includes collisions on the 73, which the CHP handles.
Aliso Creek Road and the bikeway next door
Aliso Creek Road is the city’s main arterial and carries a tolled on-ramp to the 73, which makes it one of the main commuter routes out of the city (Wikipedia). It is also where a protected bike lane pilot is running just over the city line. In August 2024, neighboring Laguna Niguel installed a one-way Class IV separated bikeway in each direction on Aliso Creek Road between La Paz Road and Alicia Parkway, and that city says the pilot inspired Aliso Viejo to evaluate similar bikeways (City of Laguna Niguel).
That matters for the city’s child cyclists. Where a crash happens along Aliso Creek Road determines whose road it is, and the stretch with the separated bikeway lies in Laguna Niguel. If a child on a bicycle is hit, the evidence to gather early includes:
- Photographs of the lane markings, bollards or curbs at the exact spot
- Witnesses’ phone numbers
- The damaged helmet and bike
- Nearby camera footage
A child’s own lawsuit deadline does not start the usual way, but a claim against Laguna Niguel or Aliso Viejo over the design of the road must still be presented within six months (Government Code §911.2), and our bicycle accident page explains how those claims are built.
La Paz Road and Moulton Parkway
Both roads carry drivers to and from the 73, La Paz through a tolled interchange and Moulton through a free one (Wikipedia). With the master plan concentrating commuter traffic onto a few arterials, the ramps and the signals near them are where rush-hour traffic is heaviest.
On these roads the investigating agency depends on which side of the ramp terminal the crash happened:
- On the ramp itself: a CHP Capistrano Area matter.
- At the signal on La Paz or Moulton: Aliso Viejo Police Services.
Asking the right agency first avoids weeks of waiting for a report that was never there. In a rear-end collision, California’s comparative fault rule still allows a driver who braked suddenly to recover, reduced by any share of fault (CACI 405).
Pacific Park and Alicia Parkway
Pacific Park is a 900-acre business park and town center, served by the toll-free Pacific Park Drive/Glenwood Drive interchange (Wikipedia). Office workers, shoppers and residents all converge here.
When a crash at these signals involves several vehicles, fault is usually divided among the drivers. Signal timing records, any city traffic camera footage and witness accounts from the town center become the core evidence.
Toll road, school ride and bikeway questions
My 12-year-old was hit riding to school. Who pays for the medical bills?
Usually the driver’s insurer, if the driver was at fault, along with any medical payments coverage on your own auto policy. A child’s claim must be approved by a court before it settles, which protects the child’s recovery.
The crash happened on the toll road. Why didn’t a deputy come?
State Route 73 is patrolled by the CHP Capistrano Area, not Aliso Viejo’s police services, so the report comes from the CHP.
Aliso Viejo’s crash numbers are low. Does that make my case harder?
No. The 92nd-place composite ranking describes the whole city over a year, while your claim turns on one collision, the injuries it caused and the records documenting them.
Is Aliso Viejo going to build separated bike lanes like Laguna Niguel’s?
Laguna Niguel says its pilot inspired Aliso Viejo to evaluate similar bikeways (City of Laguna Niguel). We have not seen a final decision, and an evaluation does not change who is responsible for a crash today.
Sidewalks, trails and the e-bike ordinance
In September 2022, the City Council unanimously approved an ordinance, effective around October 21 of that year, barring motorized devices from busy sidewalks, city parking lots and most parks. It capped sidewalk riding at 5 mph and e-bikes on designated trails at 10 mph, with Sheriff’s deputies citing violators (Voice of OC). The city also contains Soka University’s 103-acre campus and borders the roughly 2,600-acre Aliso and Wood Canyons Wilderness Park (Wikipedia), so trail and campus traffic share space with commuters.
A pedestrian knocked down on a busy Aliso Viejo sidewalk by an e-bike can point to the 2022 ordinance as evidence that the rider should not have been there. If your teenager was the rider and a car hit them, the insurer will cite the same rules, but a rider who broke the 5 mph cap can still recover for a driver’s negligence, reduced by the rider’s share, as our e-scooter and e-bike page explains.
Reports, trauma care and the courthouse
| Need | Where to go |
|---|---|
| Street reports | OCSD |
| SR-73 | CHP |
| Trauma | Mission Hospital |
| Lawsuits | Santa Ana |
| Buses | OCTA |
Police work in the city is done by Orange County Sheriff’s deputies under contract, with a Sheriff’s captain acting as chief of police services (Wikipedia); in 2022 that was Capt. Scott Merrill (Voice of OC). The city has Aliso Ridge Behavioral Health and a Hoag urgent care but no acute-care hospital, so a serious injury usually means transport to Providence Mission Hospital in Mission Viejo, the nearest Level II trauma center for adults and children (EMSA). If an Aliso Viejo claim has to be litigated and exceeds the limited-civil amount, the complaint goes to the Central Justice Center, 700 Civic Center Drive West in Santa Ana (OC Superior Court).
Deadlines: six months to present a claim to the City of Aliso Viejo, Laguna Niguel, Orange County or another public agency over a road condition or a public vehicle (Government Code §911.2); two years to sue the driver or business at fault (CCP §335.1); three years when the loss is limited to property.
Who we help in Aliso Viejo
The Law Offices of Jacob Emrani (Call Jacob) represents people injured in Aliso Viejo, including families whose children were hurt cycling on Aliso Creek Road, commuters on the 73 and La Paz Road, Pacific Park employees and Soka University students. On an Aliso Viejo case we determine whether the CHP Capistrano Area or Aliso Viejo Police Services has the report, collect records from Mission Hospital, request signal and camera evidence near the town center and identify any city or county claim deadline.
Children’s bicycle and pedestrian injuries are the cases the city’s data points to first, but our Aliso Viejo work also includes car accidents at the La Paz and Moulton ramps, motorcycle and truck crashes on the toll road, e-bike and scooter collisions on sidewalks covered by the 2022 ordinance, rideshare injuries, slip-and-fall incidents at Pacific Park retailers, dog bites and wrongful death claims. Parents of a child struck while walking to school will find more on our pedestrian accident page.
