Alameda Personal Injury Attorney
Alameda County
Alameda is the island city across the estuary from Oakland, home to an estimated 76,876 people (Census), and almost every street on it carries a 25 mph speed limit (Wikipedia). Slow streets have not made the island safe for people on foot or on bikes. In the City’s review of ten years of crash data, people walking or biking were involved in 62% of severe crashes, although they made up about 5% of commuters (Vision Zero Action Plan).
If you or someone in your family was hurt here, much of what an Alameda personal injury attorney can later prove is settled in the first three days. What follows takes that window in order and names the agencies, hospitals and streets that apply on the island.
| When | On the island |
|---|---|
| The first hour | Alameda officers, unless the CHP takes a tube crash |
| That night | Ambulances cross the estuary to Highland Hospital or Benioff Children’s |
| Day one | A hit-and-run report that keeps UM coverage open |
| Days two and three | Video along Park Street, Webster Street and the other High Injury Corridors |
| Month six | Last month to file against City Hall over a street defect |
At the tube, bridge or crosswalk
Who takes the report
Collisions on island streets, fatal ones included, are investigated by the Alameda Police Department, which also sits on the City’s Vision Zero implementation team (City of Alameda). The exception is the handful of crossings to Oakland. Only five routes take a car off the island: the Park Street, Fruitvale Avenue and High Street bridges, and the one-way Posey and Webster Street tubes under the estuary (Wikipedia).
Both agencies have worked crashes at the tubes. On December 1, 2022, a driver struck a light pole just outside the Webster tube and died, and Alameda police closed the tube to investigate. The CHP has issued traffic alerts when other crashes blocked the tubes, with backups reaching I-880 (ABC7). Hold on to whatever card the officer gave you, since the badge on it decides which records office gets your request.
Three details worth writing down
- The nearest crossing. If you were close to a tube mouth or a bridge approach, note which one.
- The cross street. Lincoln, Otis, Park and Webster all appear on the City’s corridor map, and a crash on one of them points to years of earlier collisions.
- Any school nearby. The City found that 63% of crashes injuring someone 18 or younger happened within a quarter mile of a school.
Treatment across the estuary
A pedestrian hit at island speeds can leave the scene with a fractured hip or a concussion that shows itself hours later. Older residents carry that risk most. Two-thirds of the pedestrians killed in Alameda from 2009 to 2018 were 65 or older, though that age group was about 15% of the population (Vision Zero Action Plan).
No trauma center sits on the island itself. Serious cases leave by ambulance across the estuary: adults to Highland Hospital in Oakland and children to UCSF Benioff Children’s Hospital Oakland, each a Level I center on the state’s August 2025 trauma roster (EMSA). If you declined the ambulance and went home to the East End or Bay Farm Island, see a doctor the next morning and mention every symptom, including headache and neck stiffness. Adjusters read a delay before treatment as a sign the injury was minor.
Tip: If you were walking to the ferry or an AC Transit stop, keep the ticket or fare record from that day. It fixes the time and place of the crash without relying on memory.
The first call from an insurer
Two insurers usually come into the picture quickly: yours and the other driver’s. Tell your own company about the crash, but you owe the other carrier nothing on the first day, least of all a recorded statement given on pain medication.
Watch out: When the driver who hit you drove off toward a bridge or tube, your own uninsured motorist (UM) coverage may be the policy that pays. That coverage depends on a timely police report, so report a driver who fled before the day is out.
Saving video on Park and Webster
Footage disappears fastest. Shops along Park Street and Webster Street, homes on the Slow Streets, and the ferry and bus stops near the crash all deserve a written request within 48 hours.
- A written request for video to every business facing the crash site
- Photographs of the lighting at the spot after dark, taken from where you stood
- A note of the bus route or ferry you were heading for, if you were walking to transit
- Dated photographs of bruising, casts and stitches as they change
The lighting photographs matter here. The City found that severe crashes, pedestrian crashes in particular, were overrepresented after dark on streets that had streetlights.
What the island’s crash data shows
The City set 2035 as its target for ending traffic deaths and severe injuries, first in a 2019 policy and then in a December 2021 action plan (City of Alameda). The plan’s analysis found that 73% of crashes occurred on 20% of the city’s roadways. Park Street, Lincoln Avenue and Otis Drive were singled out for their share of pedestrian and bicycle crashes, and Webster Street appears on the same corridor map (City of Alameda).
2025 on City streets: one person killed and eight severely injured, by the City’s own count. The City reports that its 2024 rate of deaths and severe injuries was 65% below the county’s (City of Alameda).
State rankings point to the same groups: children and older adults on foot, and young riders on bikes. Among 103 California cities of 50,001 to 100,000 residents in 2023, where first place means the most people hurt:
| Group | Victims | Place |
|---|---|---|
| Pedestrians under 15 | 5 | 9th |
| Pedestrians 65 and older | 6 | 15th |
| All pedestrians | 29 | 20th |
| All bicyclists | 23 | 24th |
| All road users | 198 | 71st |
Figures from California OTS. A year earlier, 10 bicyclists under 15 were hurt in Alameda, putting the city fifth among 104 peers for young riders (OTS).
Individual deaths fit the pattern. Alameda County Supervisor Wilma Chan was struck and killed while walking her dog at Shoreline Drive and Grand Street on November 3, 2021, at an intersection the City had already flagged as high-injury (ABC7). In January 2025 a 59-year-old woman walking at Ralph Appezzato Memorial Parkway and Coral Sea Street in West Alameda was hit and later died, and the City activated its Fatal Crash Response Program (City of Alameda). On Bay Farm Island, an 84-year-old pedestrian died after being struck at Mecartney Road and Marcuse Street (KTVU). Across the decade the City studied, a driver’s failure to yield was a factor in 55% of pedestrian crashes.
Claims against City Hall and other deadlines
City streets belong to the City of Alameda, so a crash caused partly by a hidden crosswalk, a broken signal or a City vehicle starts a shorter clock. A faded Lincoln Avenue crosswalk or a dark Park Street signal turns the case partly into one against the City, and then the deadline drops to six months under Gov. Code §911.2. Only the driver at fault? Then CCP §335.1 gives the injured person two years.
Shared blame does not end an island claim; California reduces the award by each side’s percentage (CACI 405). As a hypothetical example, suppose a jury decides a teenager riding home on Otis Drive bore a fifth of the blame: she still recovers four-fifths of her medical costs, lost wages and pain and suffering. A case that does not settle goes to the Alameda County Superior Court, whose rules decide the courthouse.
What island residents ask us
My child was hit walking near school. Does that happen often here?
It is a documented pattern. Most crashes injuring Alameda children happened within a quarter mile of a school, and in 2023 the city ranked ninth of 103 peers for pedestrians under 15 who were hurt.
Who writes the report for a crash in the Webster Street tube?
It depends on who responded. Alameda police investigated the December 2022 fatal crash at the tube exit, while the CHP has issued alerts for other tube crashes.
The intersection where I was hit was poorly lit. Can the City be responsible?
It can be, when a defect in City property such as an unlit crossing helped cause the crash and the claim arrives inside six months. Since 2021 the City has painted red curbs at intersections along its High Injury Corridors to improve sightlines, and its records of that work show which corners it considered risky (City of Alameda).
Is a crash at 25 mph too minor to bring a claim?
No. Speed was linked to 26% of car-versus-car crashes in the City’s study, and for a 70-year-old on foot even a slow bumper strike can break bones. A claim is measured by the injury, not the posted limit.
I was hit on Bay Farm Island near the airport road. Does that change anything?
State Route 61 runs on city streets across the Bay Farm Island Bridge toward Oakland International Airport, so airport shuttles and rideshare drivers share those lanes with residents. A rideshare driver’s commercial policy can apply when the app was on.
Our work for people hurt on the island
Call Jacob represents people injured across the island, from West End and Alameda Point residents to Bay Farm Island commuters and ferry riders bound for San Francisco. When we take an Alameda case, the early work follows a set order:
- We order the Alameda police collision report, or the CHP’s when the CHP handled a tube crash.
- We investigate whether the crash site lies on one of the City’s High Injury Corridors or near a school.
- We draft and send any government claim to the City while the tube or crosswalk evidence is still fresh.
Our island cases begin with pedestrian accidents and bicycle accidents, because the City’s numbers show those crashes do the most harm, and extend to car and motorcycle collisions, rideshare accidents on the airport route, AC Transit bus injuries, dog bites, falls at local businesses and wrongful death claims. When we represent someone hurt at a tube entrance or a bridge approach, we find out which agency responded, obtain its report and chase down video before it is erased. Anyone looking for an Alameda car accident attorney, or for an Alameda personal injury attorney after a fall or a dog bite, can expect the same attention to island records.
Talking with The Law Offices of Jacob Emrani about an island crash is free; our fee is a share of what we recover, so if we do not win, you owe us nothing. We can come to your home in Fernside or the Gold Coast, or to your bedside at Highland Hospital. The number for an auto accident lawyer in Alameda is (888) 952-2952, and you can also type out what happened on Otis Drive or at the tube in our case evaluator. Our Spanish-language site, calljacob.com/es, describes the same services.
